
For foreign physicians who would like to immigrate to Canada and who have the valuable experience that Canada needs, there are some nuances that prevent participation in the main immigration programs. Such professionals are qualified to participate in Canada’s federal economic immigration programs through the Express Entry system.
However, some eligibility criteria for federal economic programs are inappropriate for this profession. For example, a job offer must be for continuous employment in Canada for at least one year after the date the permanent residence visa was issued. But precisely in this profession the nature of the working conditions is such that the offer of employment does not specify that the work will be uninterrupted or for at least one year. In some cases, this does not allow participation in federal programs.
And yet many physicians in Canada are independent contractors who provide medical services that are funded by the Government, which actually makes them self-employed. But the period of self-employment will not be considered when calculating the period of qualifying work experience in Canada.
In recognition of the unique circumstances and nuances for physicians, the updated government policy provides for exceptions for foreign physicians whose medical services are paid for through public funds. Due to this Policy foreign physicians will be more likely to meet the criteria and be invited to apply for permanent residence.
All applicants who got invitation for a permanent resident visa through Express Entry after April 24, 2023, can be exempted from the strict rules that the IRSS adhered to previously.
